Woman accused of murdering ex-husband claims his brother stabbed him to save her from ‘the evil b*****d’ court hears

A WOMAN accused of murdering her ex-husband claimed his brother stabbed him to save her after “the evil b*****d” attacked her, a court heard today.

The Central Criminal Court sitting in Cork heard a boozy row had broken out between the three on October 8, 2018.

During the argument, the accused Rita O’Driscoll was allegedly assaulted by both the dead man Timmy Foley and his brother Jason, who is brain damaged.

Mum-of-two O’Driscoll has pleaded not guilty to the murder of Timmy Foley and assault causing serious harm to Jason Foley on October 8, 2018, at Dan Corkery Place, Macroom, Co Cork.

Garda Siobhan O’Dowd was told by Rita her ex-husband attacked her and stabbed her and Jason intervened.


Rita told gardai: “Jason stabbed my husband to pieces. He stabbed his own brother over what he did to me.

“Jason stabbed him to save me. He was an evil b*****d”.

Today, senior counsel for Rita, 48, put it to Jason: “She dropped the knife. You picked it up and it was actually you who stabbed Timmy after Rita left the house and was outside.”

This was denied by Jason Foley.

On the night of the incident, he said he saw Timmy punch Rita and she fell to the ground. Jason said he heard Timmy roaring: “Leave me alone, leave me alone.”


He added: “Rita was pulling at Timmy and he fell to the ground. He got up and gave her a few slaps to the head and tried to push her out the door.”

Jason said he went to his bedroom to get a cigarette and when he returned, Rita had a knife in her hand.

He said: “Timmy said, ‘she got me’. He put his hand to his stomach and showed me blood.”

He denied Timmy produced the knife first. The court heard Jason later told a paramedic he saw Rita stab Timmy in the chest.

He said: “I skull-dragged her off him and I kicked the s*** out of her, that’s how I got stabbed.”

The trial continues tomorrow.
